The U.S. Attorney’s Office for the District of Maine has reached a settlement with Lowe’s Companies, Inc. to address allegations regarding non-compliant access for customers with disabilities at several of its locations in Maine.
This agreement resolves an Americans with Disabilities Act (ADA) complaint filed by a customer with mobility impairments who claimed that a Lowe’s store in Brewer lacked accessible parking on the shortest route to an entrance. The investigation revealed similar issues at other locations, including Brunswick, Portland, and Windham.
Title III of the ADA states that “[n]o individual shall be discriminated against on the basis of disability in the full and equal enjoyment of the goods, services, facilities, privileges, advantages, or accommodations of any place of public accommodation by any person who owns, leases (or leases to), or operates a place of public accommodation.”
Lowe’s has agreed to implement changes to improve accessibility for individuals with mobility impairments. These modifications include providing accessible parking spaces on the shortest route to main entrances and ensuring these spaces are clear of obstructions. They will also enhance signage and designate an ADA Compliance Manager. Additionally, Lowe’s will compensate the complainant $5,000 and submit a plan within six months for surveying all locations nationwide for ADA compliance.
U.S. Attorney Darcie N. McElwee stated: “No one living with a disability should be unlawfully denied safe and unencumbered access to a retail location.” She emphasized that ensuring non-discrimination against persons with disabilities is a priority for both the Department of Justice and her office.
Lowe’s cooperated fully during the investigation.
